This website is operated by Mochi Mimi. Throughout the website, the terms “we,” “us” and “our” refer to Mochi Mimi.

By accessing our website, purchasing a product or using any part of our services, you agree to these Terms of Service and any policies referred to in them.

Nothing in these Terms of Service excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

Eligibility and account information

By placing an order, you confirm that you are legally capable of entering into a purchase agreement or have permission from a parent or legal guardian.

You agree to provide current, complete and accurate purchasing, billing, delivery and contact information. You are responsible for checking your order and delivery address before completing checkout.

Products

We try to display product descriptions, measurements, materials, images, colours, prices and availability as accurately as possible.

Some product images may include digitally created or enhanced backgrounds, styling, shadows or presentation elements. These elements are illustrative and are not included with the product. We take reasonable care to preserve the product’s actual design and appearance, although minor differences in presentation may occur. Please refer to the product description and stated measurements for exact information about dimensions, quantity, materials and included contents. Colours may vary slightly depending on lighting, photography, screen calibration and device settings.

Product packaging may occasionally change without notice. Any replacement packaging will not materially change the product itself.

We may add, modify or discontinue products at any time. Product availability is not guaranteed until an order has been accepted.

Prices

All prices are displayed in Australian dollars unless stated otherwise.

We may change product prices, discounts and availability at any time. Changes will not affect an order that we have already accepted, except where there is an obvious pricing or technical error.

Shipping charges and any applicable taxes will be displayed during checkout before payment.

Orders

After placing an order, you will receive an order confirmation at the email address or contact method provided during checkout.

We may cancel all or part of an order where:

a product is unavailable;
there is an obvious pricing, description or technical error;
payment cannot be authorised or completed;
the order is identified as potentially fraudulent or unauthorised;
the delivery address is incomplete, invalid or outside our available shipping area;
the quantity ordered is not reasonably available; or
another issue prevents us from fulfilling the order lawfully or reasonably.

If we cancel an item after payment has been received, we will refund the amount paid for that item. If the entire order is cancelled, we will also refund any shipping charge paid for that order.

Refunds will be issued to the original payment method unless otherwise agreed.

Order cancellations and changes

Customers may request cancellation through the available Shopify cancellation process within the cancellation window displayed when ordering.

You may also contact us immediately at info@mochimimi.com.au to request a change or cancellation. We will try to help, but we cannot guarantee that an order can be changed or cancelled after processing has begun.

Orders that have already been dispatched cannot be cancelled for change of mind.

Payment

Payment must be completed before an order is dispatched.

Payments are processed through Shopify and the payment providers made available at checkout. Your use of a particular payment method may also be subject to the payment provider’s terms and privacy policy.

We do not control delays caused by banks, card providers or other payment services.

Shipping and delivery

Available shipping methods, charges and estimated delivery times are displayed at checkout where applicable.

Delivery estimates are not guaranteed delivery dates. Delivery may be affected by carrier delays, public holidays, severe weather, service disruptions, incorrect delivery details or circumstances outside our reasonable control.

We will provide tracking information where tracking is included with the selected shipping service.

If an order is delayed, lost, damaged in transit or marked as delivered but cannot be located, please follow the process described in our Shipping Policy or contact us at info@mochimimi.com.au.

If we cannot supply an order within the promised or a reasonable timeframe, we will contact you and provide the options required under applicable law.

Returns and refunds

Returns, refunds and remedies are handled according to our Refund Policy.

We do not accept returns, exchanges or refunds for change of mind.

If an item is damaged, faulty, incorrect, materially different from its description or otherwise fails to meet a consumer guarantee, you may be entitled to a replacement, refund or another remedy under the Australian Consumer Law.

Promotions and discount codes

Promotions and discount codes are subject to any conditions stated with the offer.

Unless stated otherwise:

discount codes cannot be combined;
only one discount code may be used per order;
discounts cannot be applied after an order has been placed;
promotions are available only during the stated period; and
promotions may end when allocated stock is exhausted.

Nothing in this section affects rights that cannot be excluded under applicable law.

Website use

You must not:

use the website or its content for an unlawful or fraudulent purpose;
attempt to interfere with the website’s operation, security or availability;
introduce viruses, malicious code or other harmful material;
attempt to gain unauthorised access to the website, customer accounts or connected systems;
scrape, copy or extract website content using automated methods without permission;
submit false, misleading or fraudulent information; or
use the website in a way that infringes another person’s rights.

We may restrict or block access where reasonably necessary to protect the website, our customers or our business.

Intellectual property

Website content, including text, photographs, product images, illustrations, graphics, logos, branding and layout, belongs to Mochi Mimi or the relevant licensors and rights holders.

Content must not be copied, reproduced, modified, republished, distributed or used commercially without prior permission from the relevant rights holder.

Reviews and user-submitted content

If you submit a review, photograph or other content, you confirm that:

the content is accurate and based on your genuine experience;
you have the right to submit it;
it does not infringe another person’s rights;
it is not unlawful, abusive, misleading or defamatory; and
it does not contain malicious code or inappropriate personal information.

You give us permission to display and reproduce submitted content in connection with Mochi Mimi and its products, subject to applicable law and our Privacy Policy.

We may moderate or remove submitted content where reasonably necessary, but we are not required to publish every submission.

Our collection, use and disclosure of personal information are described in our Privacy Policy.

Our store is hosted by Shopify, which processes information necessary to operate the website, provide checkout and payment services, and support other store functions.

Third-party services operate under their own terms and privacy policies. We are not responsible for third-party websites or services that we do not control, except to the extent responsibility cannot lawfully be excluded.

Governing law

These Terms of Service are governed by the laws of New South Wales and the Commonwealth of Australia.

Nothing in this section prevents you from exercising rights available under applicable consumer-protection laws or bringing a claim in a court or tribunal that has jurisdiction.
